The blade runner was realised earlier this month after he served only five month of his five year sentence and he is going to be serving the rest of the sentence in his uncle’s luxury estate. He served the five month sentence at Kgosi Mampuru II prison.
The Paralympian was found guilty of culpable Homicide by Judge Thokozile Masipa after he shot his girlfriend dead on Valentine ’s Day 2013. The trial of Oscar was broadcasted live on television and the hashtag OscarTrial trended on twitter. Oscar was due to be realised on a certain day but instead he was realised the night before in escape of the media . On Monday the international media house camped outside the prisoner waiting for the man who has only served five months of his sentence. Some say that the justice is for the poor not the rich, because the rich can afford the best lawyers in the country who can fight like Barry Roux did with his client. The National Prosecuting Authority is satisfied with its appeal against Oscar Pistorius’ culpable homicide conviction but The Supreme Court of Appeal is challenging the athlete’s culpable homicide conviction. Oscar Pistorius should know by the end of the year if he will be convicted of murder or not. If Oscar is found guilty they will refer him back to Judge Thokozile Masipa so that she could sentence him again. The blade runner’s legal team still says that the Judge’s decision was based on facts that were presented to her by Barry Roux not the legal interpretation there for the decision cannot be appealed. Oscar insists that he shot Reeva Steenkamp because he thought she was an intruder and he fired four shots through a locked toilet door. Reeva’s mother has been smiling ever since the NPA decided to appeal their conviction of culpable homicide to murder. The Supreme Court of Appeal  sitting in Bloemfontein will decided whether Oscar was suppose to be charged with murder or he is rightfully convicted with the culpable homicide charge . The State Prosecutor said that the Oscar fired the shots with an intent to kill, Barry Roux says that Oscar fire the shot because he wanted to defend him self from perceived danger and he didn’t know that the Reeva was the one in the toilet. It is now up to Judge Eric Leach to decide whether Oscar is going to re-trial or his conviction will be changed from culpable homicide to murder because the court has made an error in charging  the Pistorius and that error must be verified.Barry Roux and his team  said that the Appeal Court could not just substitute a culpable homicide conviction with a murder conviction. Barry Roux is one of the best defence lawyer in the country so a re-trial would not be fair on Pistorius because he is not financially well now to afford another trial. He still remains at his uncle’s pooled house in Waterkloof under the police supervision
